Forever Trees Reforestation Project Booking Terms and Conditions.

Please review the following “Booking Terms and Conditions” as they contain critical information regarding your legal rights, remedies, and responsibilities. You should not proceed with any booking unless you fully comprehend and consent to these Booking Terms and Conditions. In these terms, references to “us,” “we,” and/or “our” denote Forever Trees Ltd. References to “you” and “your” signify the customer in these Booking Terms and Conditions. By making a booking, you agree to adhere to and be legally bound by these Booking Terms and Conditions. These Booking Terms and Conditions are applicable to any bookings made with us, whether in person, over the phone, or via email. We will rely on the authority of the person making the booking to act on behalf of any other traveller included in the booking (regardless of separate payment arrangements), and that individual will bind all such travellers to these Booking Terms and Conditions.

 

1. Visa & Passports:

All travellers must possess a valid passport for international travel, with many countries requiring passports to have at least 6 months validity beyond the return date, and some requiring a machine-readable passport. 

It is your responsibility to ensure your passports, visas, and re-entry permits meet the immigration and other governmental requirements. Any fines, penalties, payments, or expenses resulting from inadequate documentation are solely your responsibility. If you require information on visas, passports, or other travel documents for your trip, please inform us. We can provide general information on visa and passport requirements applicable to our projects. New Zealand Government advisory notices are available at www.safetravel.govt.nz.

2. Health:

You must ensure that you are aware of any health requirements and recommended precautions relevant to your destination and ensure that you carry all necessary vaccination documentation. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel.

In relation to the COVID-19 Pandemic, travel carriers, travel operators and local authorities at travel destinations may require specific testing prior to boarding and/or upon arrival at your destination. They may also require proof of COVID-19 vaccinations. Failure to present required Covid related information may result in you being denied entry into a country.

3. Prices:

All prices displayed are in New Zealand Dollars unless specified otherwise. Prices are subject to availability and may be revised or withdrawn before your acceptance and payment as prices offered by our accommodation and other suppliers can fluctuate with little or no notice, even after your booking is confirmed (due to currency fluctuations, tax adjustments, and other factors). Such price changes are beyond our control, and you will be responsible for any increases.

4. Travel Insurance:

We highly recommend purchasing travel insurance at the time you confirm your place on the project. It’s important to ensure that your insurance coverage adequately meets your potential needs, including medical expenses for sickness or injury during your trip, coverage for non-refundable items, loss or damage to your belongings. 

Please note that your travel insurance will have strict limitations and conditions, including the requirement to disclose all relevant information, including any pre-existing medical conditions.

5. Payment:

When booking on to a reforestation project with us you are required to pay a 10% deposit. Unless otherwise specified by the Consumer Guarantees Act, all deposits are non-refundable in cases of changes of mind or cancellations by you. 

A deposit secures your place on the project, but quoted prices may fluctuate before your final payment. 

Final payment is due no later than 8 weeks before departure, unless stated otherwise.

All deposits and payments will be held in a trust account until commencement of the project. 

6. Changes to travel requirements, schedules and travel services by governments or principals:

Principals or Governments may make changes without or with limited notice to routes, schedules, cancel services, or change entry, visa, health or quarantine requirements or make other decisions that impact your plans. If this occurs, we will work with you to minimise the impact on your travel, however Forever Trees Ltd are not responsible for any losses or additional costs that arise.

7. Cancellation Fees:

We highly recommend that you take out travel insurance at the time of booking your spot on our reforestation projects in case you need to cancel for unforeseen circumstances. Should you cancel your booking after payment of your deposit or full payment, the following cancellation fees apply:

  • More than 8 weeks before departure or prior to making final payment: Deposit forfeited.

  • 8 to 4 weeks before departure: 50% of payment forfeited.

  • 4 to 2 weeks before departure: 75% of payment forfeited.

  • Less than 2 weeks before departure: 100% of payment forfeited.

8. Payments by credit card:

Credit card surcharges will apply when you pay by credit card. These may vary depending on what card you use to make the purchase with. Please contact us before making your payment by credit card.

If you opt to store your credit card details with us, they will be securely saved and may be utilized for future transactions with us, whether agreed upon via phone or email. You have the option to remove your saved credit card details at any time.

9. Liability:

To the extent permitted by law, Forever Trees Ltd and its related bodies corporate, directors, employees, brokers, or agents do not accept any liability, whether in contract, tort, or otherwise, for any injury, damage, loss (including consequential loss), delay, additional expense, or inconvenience caused directly or indirectly by the acts, omissions, or defaults of third-party providers beyond our direct control. This includes events such as force majeure or other circumstances not preventable by reasonable diligence on our part.

In cases where our liability cannot be excluded and is lawfully limited, such liability is restricted to the remedies required under applicable law, including the Consumer Guarantees Act. This liability clause is subject to your rights under the Consumer Guarantees Act and does not intend to limit any rights you may have under this Act or the Fair-Trading Act.

10. Privacy Policies:

We are dedicated to safeguarding your personal information. By providing us with your personal information, you consent to how we manage your personal data, including its collection, use, and disclosure.

In specific circumstances, such as when arranging international accommodation on your behalf, we may disclose your personal information to overseas recipients. Typically, these providers will receive your personal information in the country where they deliver services or where their operations are based.

11. Governing Law

In the event of any dispute arising from the agreement between you and Forever Trees Ltd, as outlined by these terms and conditions or otherwise, New Zealand law will govern. You agree to submit unconditionally to the exclusive jurisdiction of the courts of New Zealand, waiving any right to contest legal action brought in those courts.

12. Acknowledgement:

You acknowledge that you are 18 years of age or older and that you comprehend and consent to the Booking Terms and Conditions and our Privacy Policy.
